Allegations Dismissed by the CAC

Effective February 21, 2019, the following notifications are provided in accordance with the Professional Conduct Review – Notification policy.

Dismissed:

In a decision dated December 12, 2023, the Complaints Authorization Committee (CAC) having reviewed the CAC Report dismissed an allegation filed against a total of five (5) Registrants in accordance with section 23(2) of the Registered Nurses Act, 2008. The allegation alleged that the Registrants engaged in conduct deserving of sanction in that the Registrants knew or ought to have known that an alleged patient safety incident occurred and failed to document, report, or take action in response to the alleged patient safety incident. The CAC reviewed the matter and found no evidence that the alleged patient safety incident occurred. As such, the CAC found there were no reasonable grounds to believe that the Registrants knew or ought to have known about the alleged incident or that the Registrants failed to document, report of take action in response to the alleged incident.


In a Decision dated December 7, 2023, the Complaints Authorization Committee (CAC) having reviewed the CAC Report dismissed an allegation filed against a Registrant in accordance with section 23(2) of the Registered Nurses Act, 2008. The allegation alleged that the Registrant engaged in conduct deserving of sanction in that the Registrant failed to permit the Complainant to review documents before obtaining the Complainant’s signature thereon. The CAC reviewed the matter and found that there were no reasonable grounds to believe that the Registrant’s conduct rose to the threshold of conduct deserving of sanction.


In a Decision dated September 1, 2023, the Complaints Authorization Committee (CAC) having reviewed the CAC Report dated August 1, 2023, dismissed an allegation filed against a Registrant in accordance with section 23(2) of the Registered Nurses Act, 2008.  The allegation alleged that the Registrant engaged in conduct deserving of sanction in that the Registrant misdiagnosed Slipped Capital Femoral Epiphysis (SCFE) in the Complainant’s infant child’s hip; that the Respondent misrepresented themselves as a physician and further that the Respondent was impolite in their interactions.  The CAC reviewed the matter and found that there were no reasonable grounds to believe that the Registrant engaged in conduct deserving of sanction.


In a Decision dated July 3, 2023, the Complaints Authorization Committee (CAC) having reviewed the CAC Report dismissed an allegation filed against a Registrant in accordance with section 23(2) of the Registered Nurses Act, 2008.  The allegation alleged that the Registrant engaged in conduct deserving of sanction in that the Registrant was aggressive and used offensive language on the phone with the Complainant.  The CAC reviewed the matter and found that there were no reasonable grounds to believe that the Registrant engaged in conduct deserving of sanction.


In a Decision dated May 15, 2023, the Complaints Authorization Committee (CAC) having reviewed the CAC Report dated April 18, 2023, dismissed an allegation filed against a Registrant in accordance with section 23(2) of the Registered Nurses Act, 2008.  The allegation alleged that the Registrant engaged in conduct deserving of sanction in that the Registrant mocked the Complainant to colleagues while the Complainant was anesthetized.  The CAC reviewed the matter and found that there were no reasonable grounds to believe that the Registrant engaged in the alleged conduct.


In a Decision dated April 4, 2023, the Complaints Authorization Committee (CAC) having reviewed the CAC Report dismissed an allegation filed against a Registrant in accordance with section 23(2) of the Registered Nurses Act, 2008.  The allegation alleged that the Registrant engaged in conduct deserving of sanction in that the Registrant discontinued medications against the family members wishes; prescribed medications contrary to the advice of another member of the healthcare team and best practice; all of the foregoing contributing to the death of a patient. The CAC reviewed the matter and found that there were no reasonable grounds to believe that the Registrant’s conduct rose to the threshold of conduct deserving of sanction.


In a Decision dated April 3, 2023, the Complaints Authorization Committee (CAC) having reviewed the CAC Report dismissed an allegation filed against a Registrant in accordance with section 23(2) of the Registered Nurses Act, 2008. The allegation alleged that the Registrant engaged in conduct deserving of sanction in that the Registrant provided substandard care which resulted in injury to the Complainant’s family member. The CAC reviewed the matter and found that there were no reasonable grounds to believe that the Registrant’s conduct rose to the threshold of conduct deserving of sanction.


In a Decision dated March 16, 2023, the Complaints Authorization Committee (CAC), having reviewed the Investigation Report, dismissed an allegation filed against a Registrant in accordance with section 23(2) of the Registered Nurses Act, 2008. The allegation alleged that the Registrant engaged in conduct deserving of sanction in that the Registrant misappropriated medications; failed to document medication administration and/or failed to administer medications. The CAC reviewed the matter and found that there were no reasonable grounds to believe that the Registrant’s conduct rose to the threshold of conduct deserving of sanction.


In a decision dated January 31, 2023, the Complaints Authorization Committee (CAC) dismissed an allegation filed against a Registrant.  The Allegation alleged that the Registrant engaged in conduct deserving of sanction in that the Registrant created and used two counterfeit parking permits and was dishonest with her employer upon the employer’s investigation of same. The CAC reviewed the matter and found that there were no reasonable grounds to believe the Registrant’s conduct rose to the level conduct deserving of sanction. 


In a decision dated January 9, 2023, the Complaints Authorization Committee (CAC) dismissed an allegation filed against a Registrant. The allegation alleged that the Registrant engaged in conduct deserving of sanction in that the Registrant created a public health hazard in failing to dispose of sewage appropriately. The CAC reviewed the matter and found that the alleged conduct fell outside of the scope and mandate of the College of Registered Nurses of Newfoundland and Labrador.


In a decision dated January 4, 2023, the Complaints Authorization Committee dismissed an allegation filed against a Registrant. The allegation alleged that the Registrant engaged in conduct deserving of sanction in that the Registrant failed to provide and oversee care of a patient, including failing to monitor the patient, failing to provide care that met the Standards of Practice and sleeping while on shift. The CAC reviewed the matter and found that there was insufficient evidence to support the allegation.


In a decision dated November 14, 2022, the Complaints Authorization Committee dismissed an allegation filed against a Registrant. The Allegation alleged that the Registrant engaged in conduct deserving of sanction in that the Registrant failed to provide safe and/or ethical care. The CAC reviewed the matter and found that there were no reasonable grounds to believe that the Registrant’s conduct rose to the level of conduct deserving of sanction.


In a decision dated August 31, 2022, the Complaints Authorization Committee (CAC) dismissed an allegation filed against a Registrant. The allegation alleged that the Registrant engaged in conduct deserving of sanction in the Registrant accessed patient records without authorization. The CAC reviewed the matter and found there were no reasonable grounds to believe the Registrant’s conduct rose to the level of conduct deserving of sanction.


In a decision dated July 12, 2022, the Complaints Authorization Committee (CAC) dismissed an allegation filed against a Registrant. The Allegation alleged that the Registrant engaged in conduct deserving of sanction in that the Registrant failed to meet the Standards of Practice of a Registered Nurse in the provision of care during the Complainant’s hospitalization. The CAC reviewed the matter and found that there were no reasonable grounds to believe the Registrant’s conduct rose to the level conduct deserving of sanction.


In a decision dated July 12, 2022, the Complaints Authorization Committee (CAC) dismissed an allegation filed against a Registrant. The allegation alleged that the Registrant engaged in conduct deserving of sanction in that the Registrant failed to meet the Standards of Practice of a Registered nurse in the provision of care during the Complainant’s hospitalization. The CAC reviewed the matter and found that there were no reasonable grounds to believe the Registrant’s conduct rose to the level conduct deserving of sanction.


In a decision dated May 9, 2022, the Complaints Authorization Committee (CAC) dismissed an allegation filed against a Registrant. The allegation alleged the Registrant engaged in conduct deserving of sanction in that the Registrant accessed, on more than one occasion, patient records without authorization as the individuals were not within the Registrant’s circle of care. The CAC reviewed the matter and found there were no reasonable grounds to believe the Registrant’s conduct rose to the level of conduct deserving of sanction.


In a decision dated April 1, 2022, the Complaints Authorization Committee (CAC) dismissed an allegation filed against a Registrant. The allegation alleged the Registrant engaged in conduct deserving of sanction in that the Registrant did bear false witness in written and signed document related to a workplace incident. The CAC reviewed the matter and found there were no reasonable grounds to believe the Registrant’s conduct rose to the level of conduct deserving of sanction.


In a decision dated April 1, 2022, the Complaints Authorization Committee (CAC) dismissed an allegation filed against a Registrant. The allegation alleged the Registrant engaged in conduct deserving of sanction in that the Registrant did bear false witness in written and signed document related to a workplace incident. The CAC reviewed the matter and found there were no reasonable grounds to believe the Registrant’s conduct rose to the level of conduct deserving of sanction.


In a decision dated March 31, 2022, the Complaints Authorization Committee (CAC) dismissed an allegation filed against a Registrant. The allegation alleged that the Registrant engaged in conduct deserving of sanction in that the Registrant and was guilty of conduct unbecoming a Registered Nurse as a result of statements made in a public forum. The CAC reviewed the matter and found that there were no reasonable grounds to believe the Registrant’s conduct rose to the level of conduct deserving of sanction.


In a decision dated March 31, 2022, the Complaints Authorization Committee (CAC) dismissed an allegation filed against a Registrant. The allegation alleged that the Registrant engaged in conduct deserving of sanction in that the Registrant failed to document and/or failed to document appropriately; failed to complete assessments; failed to communicate with a physician; and/or administered a medication inappropriately. The CAC reviewed the matter and found that, even if proved, the Registrant’s conduct did not rise to the level required to establish reasonable grounds to believe the Registrant engaged in conduct deserving of sanction.


In a decision dated February 18, 2022, the Complaints Authorization Committee dismissed an allegation filed against a Registrant. The allegation alleged that the Registrant engaged in conduct deserving of sanction in that the Registrant failed to provide and oversee care of a Resident, including failing to advocate on behalf of a client, providing inaccurate information about a client and delaying treatment for a client. In addition, the allegation alleged that the Registrant lacked empathy and compassion. The CAC reviewed the matter and found that there was insufficient evidence to support the allegation.


In a decision dated February 21, 2022, the Complaints Authorization Committee dismissed an allegation filed against a Registrant. The allegation alleged that the Registrant engaged in conduct deserving of sanction in that the Registrant failed to monitor the Complainant’s condition resulting in a worsening of the Complainant’s condition leading to a necessary overnight observation in hospital and that the Respondent failed to communicate with a doctor in a timely fashion. The CAC reviewed the matter and found, considering the evidence before them, that the conduct did not rise to the level sufficient to conclude that there were reasonable grounds to conclude the Respondent engaged in conduct deserving of sanction.


In a decision dated February 23, 2022, the Complaints Authorization Committee dismissed an allegation filed against a Registrant. The allegation alleged that the Registrant engaged in conduct deserving of sanction in that the Registrant failed to appropriately triage the Complainant when the Complainant attended for care and that the Registrant subsequently falsified and/or tampered with medical records by completing a triage report without assessing the Complainant. The CAC reviewed the matter and found, considering the evidence before them, there were no reasonable grounds to believe the Registrant engaged in conduct deserving of sanction.


In a decision dated November 16, 2021, the Complaints Authorization Committee dismissed an allegation filed against a Registrant. The allegation alleged that the Registrant engaged in conduct deserving of sanction in that the Registrant failed to provide and oversee care of a Resident, including failing to monitor nutritional intake and personal hygiene; and failing to provide physiotherapy and wound care.  In addition, the allegation alleged that a request for a second opinion from a medical care provider was denied. The CAC reviewed the matter and found there was insufficient evidence to support the Allegation.


In a decision dated October 6, 2021, the Complaints Authorization Committee dismissed an allegation filed against a Registrant. The allegation alleged that the Registrant engaged in conduct deserving of sanction in that the Registrant attended the Complainant’s place of work and while there, made negative comments about the Complainant to the Complainant’s coworkers. It was alleged that the Respondent’s actions were premediated and intentional with the goal of slandering the Complainant’s name in front of the Complainant’s present employer and clients. The CAC reviewed the matter and found the matter to be outside of the scope and mandate of the College.


In a decision dated October 6, 2021, the Complaints Authorization Committee dismissed an allegation filed against a Registrant. The allegation alleged that the Registrant engaged in conduct deserving of sanction in that the Registrant breached the Complainant’s confidentiality by disclosing that the Complainant inquired about obtaining elective medical services from the Registrant’s place of employment. The CAC reviewed the matter and found the matter to be outside of the scope and mandate of the College.


In a Decision dated August 18, 2021, the Complaints Authorization Committee dismissed an allegation filed against a Registrant.  The allegation alleged the Registrant engaged in conduct deserving of sanction in that the registrant demonstrated professional misconduct and conduct unbecoming of a registered nurse while in attendance at the offices of the College of Registered Nurses Newfoundland and Labrador.


In a decision dated August 3, 2021, the Complaints Authorization Committee dismissed an allegation filed against a Registrant.  The allegation alleged the Respondent engaged in conduct deserving of sanction due to professional incompetence in that the registrant stopped a client’s medication on admission to a facility, failed to communicate with the client’s family, failed to respond to the family’s request for a second opinion and failed to manage the client’s pain appropriately. 


In a Decision dated May 26, 2021, the Complaints Authorization Committee dismissed an allegation filed against a Registrant.  The allegation alleged that the Registrant engaged in conduct deserving of sanction due to professional incompetence in that the registrant failed to ensure proper processes were carried out in the workplace and erred in classification of an adverse event when reporting the incident.


In a Decision dated October 26, 2020, the Complaints Authorization Committee dismissed an allegation filed against a Registrant. The allegation alleged the Registrant’s actions, in response to the COVID-19 pandemic, placed the public and other individuals at risk.


In a Decision dated October 26, 2020, the Complaints Authorization Committee dismissed an allegation filed against a Registrant. The allegation includes issues of the Registrant’s actions in the workplace in response to the COVID-19 pandemic, a professional recommendation and professional communication.


In a Decision dated October 26, 2020, the Complaints Authorization Committee dismissed an allegation filed against a Registrant. The allegation alleged the Registrant’s actions, in response to the COVID-19 pandemic, placed the public and other individuals at risk.


In a decision dated May 11, 2020, the Complaints Authorization Committee dismissed an allegation filed against a Registrant.  The allegation included issues of medication administration.


In a decision dated March 19, 2020, the Complaints Authorization Committee dismissed an allegation filed against a registrant. The allegation included issues of care planning, administration of a medication and a report made under the Adult Protection Act.


In a decision dated April 9, 2019 the Complaints Authorization Committee dismissed an allegation filed against a Registrant. The allegation related to the provision of service and communication issues arising during the Registrant’s interaction with a client.


In a decision dated March 28, 2019, the Complaints Authorization Committee dismissed an allegation filed against a Registrant.  The allegation included issues of delegation of duties, completion of quality assurance checks, scheduling of patient appointments and communication and behaviour with colleagues.
